Adverse Possession

Adverse possession of land occurs most commonly where a fence between neighbours is not on the correct boundary. This can cause many issues and owners are often not aware that the fence is on the wrong boundary until they propose to undertake an extension or development of the site.

 

Where land is occupied by owners for over 15 years, the land may be able to be claimed pursuant to the legal principle of adverse possession.
